That is to say, if a lower Court believes that there is a major dispute regarding the application of law in a certain case, it can submit a request for instruction.

Of course, theoretically, this request for instruction should only apply to the application of law and cannot interfere with the actual judgment of the case.

But… those who understand know about such matters. If the Supreme Peoples Court gives you an approval, it indicates the Supreme Peoples Court's attitude.

However, according to regulations, you cannot state in the judgment that it was based on an instruction.

The approvals we know about now are all publicly released by the Supreme Peoples Court through special procedures in accordance with regulations.

For example, what lawyers often refer to as “the Supreme Peoples Court’s approval on such and such a matter”—this is a situation where an instruction and its answer are made public.

Similarly, according to Article 19 of the “Supreme Peoples Court Provisions on Requesting and Answering Questions Regarding the Application of Law,” if the legal application issue addressed by the answer has universal guiding significance, the people’s Court that submitted the request can compile a case and recommend it as a candidate guiding case to the Supreme Peoples Court.

This is why Zhou Yun is very confident!

The scale of this situation is too large, so there is a high possibility that Jiangguang will submit a request for instruction. In such a situation, once the Supreme Peoples Court gives an answer, there is a high possibility that this case will become a guiding case.
