96: Wu Junxian, why did you mess with a madman!

Many people have heard that criminal law is characterized by its humility.

So what does humility mean? In layman's terms, criminal law is only invoked when other laws are truly unable to manage a situation.

You can view criminal law as the true “bottom line.”

This has also led to many principles, such as “legality of crimes and punishments” and “no punishment without a clear legal provision.”

Director Huo's point was that criminal law likely doesn't stipulate that operating a labor dispatch business without qualifications is a crime, so according to the principle of no punishment without a clear legal provision, it hasn't reached the level of a crime.

However, Zhou Yun's meaning was that the situation was already extremely serious!

It's like the unfinished building problem from before; many things are just afraid of being investigated. Usually, everyone just deceives each other, but once someone genuinely investigates, they'll discover the situation is very severe.

And there are some catch-all provisions in criminal law, the most familiar of which is the crime of picking quarrels and provoking trouble.

The fourth circumstance of the crime of picking quarrels and provoking trouble: creating disturbances in public places, causing serious disorder in public places.

Public places, besides one's home, can all be considered public places. Serious disorder—what constitutes serious disorder? There's no clear definition, and that's what's called a catch-all provision.

Similarly, the crime of illegal business operations is the same; the fourth circumstance is called: other illegal business operations that seriously disrupt market order.

The legal community has long criticized various catch-all provisions.

And the crime of illegal business operations, the crime of picking quarrels and provoking trouble, and the crime of endangering public safety by dangerous means were the three most famous “pocket crimes” back then.

Of course, by now, the legal community believes that some new crimes also show a trend towards being “pocket-like,” such as the crime of assisting information network criminal activities, commonly known as the “bangxin crime,” which many people are familiar with.

However, the reason for these catch-all provisions is simple: because laws have a lag.

In layman's terms, laws certainly cannot keep up with the times, so if the principle of “no punishment without a clear legal provision” is strictly adhered to, a situation will arise.

A certain behavior might be very serious, but there are no suitable provisions to address it.

A ready example in reality is the crime of illegal business operations, like the crackdown on online trolls a couple of years ago, which ultimately fell under the crime of illegal business operations.

The basis was the “Measures for the Administration of Internet Information Services.”

Article 4 of these measures stipulates that the state implements a licensing system for commercial internet information services.

In other words, one must obtain state permission to engage in internet information services, so the leaders of online trolls engaged in illegal business operations, seriously disrupting market order, and were convicted of the crime of illegal business operations.

Similarly, labor dispatch also requires qualifications and has an entry system. These bosses engaged in illegal business operations without qualifications, seriously disrupting market order, so why can't they be convicted of the crime of illegal business operations?

Is the human resources market not a market?

Zhou Yun's words left Director Huo dumbfounded, or rather, he had never thought in that direction before.

Because it's impossible for anyone to conduct such an investigation; the Arbitration Committee and the Court are similar, they're like spinning tops, they won't move unless whipped.

So as long as no one comes to file for arbitration, it means there's no problem, and there's no need for proactive intervention.

He was speechless, completely speechless.

Zhou Yun continued: “So, Director Huo, this matter is logically sound in legal theory, and now, our evidence has already been collected!

“Let's report the case together, it will definitely work out!”

Laws, in the end, all come down to economics. Economic base determines the superstructure—this is a common phrase we used to see in political textbooks.

All accounts, when calculated to the end, are economic accounts!

The Public Security Bureau cannot endlessly invest manpower and resources into investigating every case, because these are limited, and police funding is only so much.

This is a very realistic problem: no money.

But now, Zhou Yun has already prepared all the evidence; as long as they file the case and follow the procedures, this case will be settled!

Director Huo was convinced. In this situation, it indeed seemed possible to proceed… Sigh, it would just be another hardship for the labor bosses.

With Xinguang District settled, Zhou Yun began to visit other districts. Not too many were needed, just three or four districts together, and the Public Security Bureau would definitely file the case!

In short, what he had to do was unite all forces that could be united.

Some gained political achievements, some received their salaries, and some went to jail. Don't you think this is good?

Outside, Ren Weihao was making a phone call with a gloomy expression.

“Wife, hurry up and find a way to transfer the money in our company's account. I’ve run into a lunatic, and now the labor inspection is going to investigate!”

“I estimate there will be fines later. We'll just transfer the money, deregister this company, and quit. We'll start again after the storm passes.”

Ren Weihao briefly explained the situation, then cursed, “It's all that damn Wu Junxian's fault. He's sick, insisting that Jinghai is all like this.”

“That Zhou Yun clearly has a problem in his head. Why provoke him? I swear, when I see that guy Wu, I'm going to beat him up!”

At this point, practically every boss was cursing Wu Junxian, but no one was cursing Zhou Yun.

Because now everyone realized that Zhou Yun seemed to have something wrong with his head; no normal person would do something like this.

What's the use of cursing a crazy person with a problem in his head? And no one could afford to provoke Zhou Yun…

In the crowd, a boss who had a good relationship with Wu Junxian walked aside and dialed a number.

“Hello, Old Wu, what are you doing?”

On the other end of the phone, Wu Junxian laughed, “Nothing, what's up?”

“I'm asking you, did you run into trouble a while ago, related to that lawyer named Zhou Yun in our Jinghai?”

Wu Junxian's heart skipped a beat upon hearing this, but he still said, “You know? Ah, bad luck, I ran into a lunatic. That guy filed over two hundred cases against me, he's purely sick!”

On this end of the phone, the friendly boss gritted his teeth and said, “Then did you tell that Zhou Yun that Jinghai is all like this, and that if he had the guts, he should sue everyone, is that right?!”

Wu Junxian said somewhat helplessly, “I did say that, but that was just angry talk, is there a problem?”

“Is there a problem? There's a big problem!” the friendly boss roared, “Do you know what that Zhou Yun did? He filed over ten thousand cases, suing over a hundred labor bosses in ten districts and three counties of our Jinghai!”

“And, he directly said that it was because of your words, Wu Junxian, that he did this. Old Wu, do you know how big the problem is now?”

“Hello, Old Wu? If you don't speak, I'm hanging up.”

But Wu Junxian's phone had already fallen to the ground, and only one sentence echoed in his mind: Zhou Yun really sued all the labor agencies in Jinghai.

Suddenly, Wu Junxian stood up in a rage, picked up his phone, and smashed it on the ground: “Damn, damn you, Zhou Yun!”
