41: What I want is not compensation, but your attitude!
The Public Security Bureau arrived and, after understanding the situation, immediately took Zeng Xiaolu into custody.
The facts of this case are now very clear; if Zeng Xiaolu had merely found an excuse to ask for or borrow money from the man, it would generally not be classified as fraud.
There are many such cases in reality; generally, for these situations, if you report them, you will be told it's an economic dispute and advised to sue.
Specifically, borrowing money is a loan dispute, and asking for money depends on the amount and specific circumstances; if the amount is very large and it's not a special date or a special number, it's usually considered a “gift for the purpose of marriage.”
And if they are already married and then she receives money from the man, it generally won't be classified as fraud.
However, when the two are combined—a married woman using the pretense of a romantic relationship to fabricate facts and ask for money from a man—then there is a strong suspicion of fraud.
Originally, there was still the possibility of it being a “gift for the purpose of marriage,” but once the woman herself denied this in Court, there was no way around it.
The leading Police Officer, after understanding the situation, also glanced at Zhou Yun, wondering if this guy was setting a trap for someone!
The key was that he calculated the other party's actions perfectly; after the trial began, the woman's side jumped right into it without any hesitation.
Although Zeng Xiaolu was already somewhat despairing, she still tried to explain: “Police Comrade, I didn't intend to defraud him; I just… just took some money from him, I didn't intend to defraud him of money.”
“I really didn't intend to defraud him of money, I just… I really did want to be in a relationship with him before.”
But at this point, whatever she said was useless.
The Police Officer wanted to take her away, and she struggled desperately, but soon a silver handcuff with a cold touch was placed on her wrist.
The effect of this item is very strong; after all, it's part of the “Regret Series” equipment, alongside the “Regret Chair” in the interrogation room.
Basically, many agitated people calm down as soon as they put this on.
Zeng Xiaolu did calm down; her face was full of fear, but she was still directly taken away by the Police Officer.
Also taken away was that lawyer, though of course the lawyer was only there to cooperate with the investigation.
With everyone taken away, the Court suddenly felt much emptier. Zhou Yun looked up: “Presiding Judge, my evidence ambush was also a last resort…”
Although civil proceedings can be disregarded once criminal proceedings begin, an explanation was still necessary, as they were all in Jinghai City, and he might still come to Yangshan District Court in the future.
The Presiding Judge waved his hand, indicating it was fine, and smiled: “Next time you encounter such a situation, you can communicate with us in advance; there’s no need to do it this way.”
Zhou Yun quickly nodded… but if there was a next time, he would still do it this way.
Having handled countless cases in his previous life, many Judges in various Courts also held the attitude of “the less trouble, the better,” especially those who were a bit older.
In contrast, younger Judges, especially those who had just been appointed, would be more attentive when handling cases.
Some individual Judges would just flip through the materials during the trial, and then hand over the judgment and other documents to the Judge's assistant to write, or some even handed them to the Clerk to write.
Although some Clerks might have more experience than many lawyers, they are ultimately just Clerks, and now many Clerks in Courts are even temporary staff.
So it’s still better to do it yourself.
Soon, Zhou Yun and Wang Sheng Gang left the Court.
Wang Sheng Gang hesitated for a long time before finally asking: “Lawyer Zhou, will she… will she definitely be sentenced?”
Zhou Yun spread his hands: “Fraud of eighty thousand yuan is already considered a huge amount, punishable by fixed-term imprisonment of three to ten years, and a fine. Don’t worry, she’ll definitely go in.”
Wang Sheng Gang was stunned again: “Lawyer Zhou, I… I’m not worried about that, I’m…”
“Oh, you mean the money? You don't have to worry about that; anyone with a bit of sense will proactively return the money to seek your forgiveness, and they might even give you more. Don't worry.”
Wang Sheng Gang fell silent. He now realized that he couldn't communicate with Lawyer Zhou at all.
It seemed as if there was no consideration for romantic feelings in the other party's mind; everything was based on “the law.” By the way, Lawyer Zhou was also a young person, wasn't he?
Zhou Yun continued: “In short, you now have the upper hand. Also, congratulations, Writer Wang, you’ve achieved another accomplishment.”
“The accomplishment of sending your ex-girlfriend to jail!”
Wang Sheng Gang no longer wanted to speak and could only nod in silence, after all, Lawyer Zhou was truly wholeheartedly considering his interests.
And Zeng Xiaolu… he really hadn't expected her to be in such a situation.
He had actually tried to commit suicide for her playing disappearances before; thinking about it now, it felt utterly ridiculous.
“Well then, that’s it. You can go home. I also need to go back to work… Oh, right, there will be some things in the criminal case later. Considering you don’t want to deal with the other party, I’ll handle it.”
“I'm leaving!”
After speaking, Zhou Yun turned and left.
Wang Sheng Gang looked at the other party's back, wishing he could be as carefree as Lawyer Zhou.
Zhou Yun didn't return to the law firm; after much consideration, he decided not to activate the task for this case, mainly because it wasn't that big.
However, he definitely had to make a video of it and post it online, as such cases are rare and hard to come by.
Thus, Zhou Yun continued to work on other cases while making the video, and also waited for updates on Zeng Xiaolu’s situation.
Meanwhile, Zeng Xiaolu was already sitting in the Regret Chair.
Don't let her PUA skills against Wang Sheng Gang fool you; once she sat in the Regret Chair, she confessed everything like spilling beans from a bamboo tube, without much interrogation.
“So, before this, you also asked for money from another man using the same method, correct?” the interrogating Police Officer asked while taking notes.
Zeng Xiaolu nodded, which was pretty much as Zhou Yun had predicted; she had done this before.
PUA is also a skill; to play it so smoothly, one must have prior experience.
In fact, even if she didn't confess, it wouldn't matter; the Public Security Bureau had already investigated most of her previous activities.
Facing the interrogation, Zeng Xiaolu suddenly broke down emotionally, crying hysterically while sitting in the Regret Chair.
“I had no idea that was fraud; if I had known, there’s no way I would have done that…”
The Police Officer didn't know what to say and could only notify her family to come.
Perhaps it could be said that she wasn't remorseful; she was just regretful about being caught.
Just as Zhou Yun said, why would someone give you money for no reason? Didn't you think about it yourself?
This kind of easy money, did you really think there would be no consequences?
Methods for making money are written in the criminal law.
One can only say that the internet is too complex now; on some platforms, some people, to attract attention, specifically teach methods of “how to get money from men.”
But a closer look reveals that it’s nothing more than using a romantic relationship as an excuse to ask for money, which indeed isn’t a crime, but the man can request a refund.
It’s just that lawsuits are too complicated, and generally, few men are willing to pursue them.
That afternoon, Zhou Yun received a call from an unknown number; the caller identified herself as Zeng Xiaolu's defense lawyer and had obtained his contact information from the Public Security Bureau.
Because he had previously communicated specifically with the Public Security Bureau, he had obtained full power of attorney from Wang Sheng Gang, and Wang Sheng Gang, due to special reasons, did not want to have contact with the other party.
The Police Officers understood this; all men get it, it's a tearful story.
In the phone, Zeng Xiaolu's defense lawyer's voice rang out: “Lawyer Zhou, since we are both lawyers, let's be direct. What conditions do you require for issuing a letter of understanding?”
At this time, demanding an exorbitant price cannot be considered extortion, because this is actually a criminal settlement conducted under the auspices of the Public Security Bureau.
Therefore, Zhou Yun directly said: “The conditions are very simple. Firstly, all the transfers and gifts Zeng Xiaolu received initially must be returned. If anything cannot be returned, it should be converted into cash and returned. Is that clear?”
The defense lawyer on the other side quickly said: “That is absolutely no problem. We can proceed with the return directly today.”
“But the gifts have now been taken by the Public Security Bureau for appraisal, so how about we just give cash, according to your demands during the trial, eighty-three thousand yuan?”
This request basically amounted to returning the ill-gotten gains, and the opposing lawyer agreed without any hesitation.
Zhou Yun chuckled and said: “Please wait a moment, I haven’t finished.”
“Returning these is only one aspect. On another note, during their year-long relationship, Zeng Xiaolu caused immense emotional distress to our client through PUA tactics.”
“Therefore, an additional fifty thousand yuan in compensation for emotional distress must be paid to our client, Wang Sheng Gang.”
This was basically asking for the maximum amount; according to the “Interpretation of Several Issues Concerning the Determination of Liability for Mental Damage in Civil Infringement Cases by the Supreme Peoples Court,” the highest compensation for severe mental damage is fifty thousand yuan.
Anyway, it was just an exorbitant demand.
Any negotiation conducted through official channels is fine.
As the words “fifty thousand yuan” fell, the lawyer on the other side immediately said: “Lawyer Zhou, that’s impossible. Fifty thousand yuan in emotional distress compensation, that’s something we absolutely cannot give.”
Zhou Yun chuckled again upon hearing this: “Impossible to give? Then I also have no way to issue a letter of understanding. Fifty thousand yuan, it depends on Zeng Xiaolu’s attitude.”
I don't want your money; I just want to see your attitude.
“Let’s put it this way: if Zeng Xiaolu doesn’t even offer fifty thousand in emotional distress compensation, what does that indicate? It indicates she hasn’t recognized her mistake at all.”
“If she hasn’t recognized her mistake, then why should she be forgiven?”
“After all, Zeng Xiaolu once said, ‘What I want isn’t money, but your attitude.’ Now I’m sending that same line back to her.”
On the other end of the phone, a middle-aged woman looked at her phone with a bewildered expression.
She was Zeng Xiaolu's defense lawyer, and now she felt as if she had been hit by a punch.
This was like, “What I want isn’t a bride price, but your attitude,” and “If you don’t even give me this, it means you don’t love me at all.”
Never mind, the middle-aged woman decided to go back and talk to Zeng Xiaolu again.
So, during their meeting the next day, the middle-aged woman relayed these words to Zeng Xiaolu.
“Wh-… What? It’s not about money, it’s about my attitude? This… this was said by that lawyer named Zhou Yun? Is he insane?!”
Zeng Xiaolu now truly felt that Zhou Yun was insane. What kind of nonsense attitude? Could that be the same thing?!
Attitude ≠ Attitude!
But the key was that if she couldn't get the letter of understanding now, seven or eight years in prison were definitely unavoidable!
There was no way, truly no way, Zeng Xiaolu said: “I, I agree, isn’t that enough? I’ll give it, I’ll give the fifty thousand too!”
She actually had money, she just hadn't wanted to give it before.
As for her family, Zeng Xiaolu knew very well that they would definitely not be willing to pay, so she had to pay.
This lawyer is truly outrageous!
The middle-aged woman in front of her nodded, then began communicating with the Public Security Bureau, because after Zeng Xiaolu was arrested, all her Bank cards had been frozen.
It should be noted here that not all criminal cases result in frozen Bank accounts; generally, only cases involving financial compensation or potentially large fines will lead to freezing.
After all, in some economic and financial crimes, all assets may be confiscated, and if not frozen in advance, they could very likely be transferred away.
Don't underestimate human daring; there are many people willing to take risks for profit.
At home, Wang Sheng Gang hadn't left the house for several days; he didn't want to do anything now.
However, just today, Wang Sheng Gang received a call from Zhou Yun.
“Hello, Old Wang, good news, great news! The other party is willing to return all the money you transferred and gifts you bought before, and they are also willing to compensate you for your emotional distress!”
“The compensation amount is fifty thousand yuan. Of course, after receiving the compensation, you’ll need to issue a letter of understanding.”
“Hello? Why aren’t you talking? I got you fifty thousand back, don’t you think that’s good news?”
Poor Writer Wang finally managed to say after a long silence: “It’s good news.”
“That’s right then. Come to the firm later, bring your Bank card, and sign the letter of understanding while you’re here.”
After speaking, Zhou Yun hung up the phone, leaving Wang Sheng Gang feeling somewhat speechless.
It could be said that Zhou Yun, relying solely on the law, had completely shattered Wang Sheng Gang's simping heart.
What's wrong? I'm a professional lawyer, and I got you so much money, and you still dare to say this isn't a good thing?
What was he thinking before… It seemed he wanted to meet her again and see if they could reconcile.
But somehow, it inexplicably turned into “just wanting to meet the other party,” and then later, inexplicably, it became “wanting the other party to return the money.”
And now, his demand has again become “only if they give more money can they be forgiven.”
He knew about every change, but he couldn't say anything, because that Lawyer Zhou was truly acting for his benefit.
Thousands of words finally converged into one sentence: that Lawyer Zhou was truly a genius.
The normal procedure for criminal settlement is that the suspect deposits the corresponding funds into an account provided by a notary office or the Public Security Bureau.
Then, the victim takes the letter of understanding to withdraw the funds.
So, in some cases, if the victim insists on an exorbitant price and refuses to issue a letter of understanding without it, and the suspect genuinely cannot afford that much money, then the suspect's lawyer will suggest doing this:
Deposit the maximum possible compensation into the corresponding account at the notary office, thereby demonstrating that they have made the utmost effort to compensate.
Although there is no letter of understanding, they have indeed tried their best.
Generally, when a Court encounters such a situation, even without a letter of understanding, it will be considered during sentencing.
Zeng Xiaolu was arrested, and Wang Sheng Gang received over a hundred thousand yuan, but he couldn't feel happy at all.
Meanwhile, Zhou Yun had largely finished the video and was doing the voiceover.
“Many people might have seen clips of this case. It started with a young man who wanted to jump into a river calling me for a live chat, and I told him it was easy to meet the other party.”
First, the origin of the case, including Zhou Yun persuading Wang Sheng Gang, and that classic quote: If you don't even dare to sue, how can you still claim to love her!
Then came the lawsuit and mediation, where Zhou Yun investigated and found out about the other party's marriage.
“At this point, I didn’t report it, because it wouldn’t have been easy to file a case then. So I continued with the lawsuit, and during the lawsuit, I made them admit it themselves!”
“The trial was a trap I dug for them. As expected, the other party jumped right in, because any normal person wouldn’t deny it…”
“Then I presented the evidence, and the Court transferred the case. In such circumstances, the Public Security Bureau is required to investigate.”
And so, all the way to the end, Zhou Yun included his conversation with the opposing lawyer.
“I think this is fine, after all, what I want isn’t money, but the other party’s attitude. If they don’t even give fifty thousand in compensation, it clearly shows they have no intention of settling.”
Zhou Yun’s serious tone combined with these words gave the entire case a different, highly ironic feel.
The video was finished; he reviewed it and found no issues. Then Zhou Yun typed out the title: What I want isn’t money, but your attitude!
