7: This is bullying to me!
Today, the sun was still very bright, and Lu Bin, the Director of the Fengxian County Labor and Personnel Dispute Arbitration Court, made his way to the office.
No sooner had he sat down than someone knocked on his door and entered.
"Director, yesterday we encountered a very troublesome Arbitration application. The others don't know what to do, so please take a look." A staff member said, placing the documents on the table.
Lu Bin immediately frowned upon hearing this: "What kind of Arbitration application can't you handle that you have to send it to me?"
"Is this how you do your work? Alright, alright, I'll take a look."
As he spoke, Lu Bin picked up the application form in front of him and glanced at it. His reaction was the same as the counter staff yesterday; he instinctively started rubbing his eyes.
He truly had never seen a situation like this!
"Director, you didn't see wrong. The respondent is indeed the Court. What do you suggest we do?" The staff member said with a bitter smile.
In all these years at the Arbitration Committee, he had never encountered something so outrageous. The Court is the judicial body; the Arbitration Committee is only granted certain powers.
If the other party doesn't accept the Arbitration ruling, they still have to go to the Court, and enforcement also has to go to the Court.
After frowning and looking for a while, Lu Bin finally made a decision: "Just ignore it. It's hard to say if we should give notice, and it's also hard to say if we shouldn't, so there's no need to bother with it."
Given the relationships in this small county, if he really let the Arbitration Committee accept it, who knows what the Court would think.
So, he decided against it. Anyway, failure to accept within the time limit could still be considered as having gone through the preliminary procedures.
After the staff member left, Lu Bin shook his head: "This lawyer is a talent. Isn't he afraid of completely offending the Court?"
Zhou Yun submitted two application forms yesterday, but only one was delivered to the leadership. The other was naturally accepted according to normal procedures.
The regulation states within five working days, but normally it takes about two or three days.
Meanwhile, in Jinghai, Zhou Yun had already become completely busy, and what surprised the Tianhe lawyers even more was that on the third day, Zhou Yun took on two more cases!
This was a bit outrageous. How could a mere newcomer have so many case sources!
In the Director's office, Zhou Meixia said with great dissatisfaction: "Director, what do you think that Zhou Yun is doing? How is he getting his case sources? He doesn't even think to say anything if he has a good method."
Jiang Qiming, however, remained calm: "Look, you're getting anxious again. Zhou Yun is clearly too young. Taking on eight cases at once, does he have that level of skill?"
A lawyer's energy is also limited. If they take on too many cases at the same time, there might be conflicts in scheduling, and additionally, the lawyer themselves might make mistakes due to being too busy.
For example, you might see news about a lawyer not appearing in Court for a certain case; that's because they took on too many cases and forgot about that hearing.
"Moreover, how difficult are clients these days? If they just give a small complaint, won't the firm and the Lawyers Association handle it properly then?"
Upon hearing this, Zhou Meixia immediately nodded. That's right.
Zhou Yun naturally knew that many people were hoping for him to stumble at this moment, which was normal.
If he were truly a newcomer, he would probably be as busy as a dog by now.
But he had been deeply involved in the legal industry for so many years, with rich experience. These small cases were handled in an orderly manner, and it was impossible for problems to arise.
However, his main focus was still on the labor dispute case, because that involved his task.
On the fourth day, at Fengxian County Yuanhe Human Resources Company, the company boss Shi Yongqiang was joking around with his secretary.
How to describe this kind of company? There are very, very few formal employees, usually only three or four people.
The boss is the core, relying on various skills to get business. One accountant is responsible for payroll, plus one person for miscellaneous tasks and errands, and another for handling contracts. That's enough.
Of course, they might also call in a few idle people... to prevent anyone from coming to cause trouble.
It looks simple, but those who can consistently get labor outsourcing work from various units in the county are not simple; they make a lot of money.
Just then, the office door was knocked.
The female secretary quickly got off his lap. Shi Yongqiang said discontentedly: "Who is it?"
"General Manager Shi, it's me!"
Along with the voice, one of the company's employees walked in.
"What's wrong?" Shi Yongqiang asked, frowning.
"We just received a notice for a hearing from the county's labor Arbitration, saying that our employee went to the Arbitration Committee and sued us." The employee quickly said.
"Our employee? Are you out of your mind? Our company only has a few of us. Who would sue us?" Shi Yongqiang yelled, glaring.
He had just been interrupted, and now he was very angry!
"No, General Manager Shi, it's that... that person named Liu Fusheng. He said he was our company's employee, and we fired him, so we need to pay some labor compensation and so on..."
As he spoke, the employee handed over the duplicate application form: "Look, General Manager Shi, many things are listed on it."
Shi Yongqiang took it and looked, almost getting his nose twisted in anger.
Several points were listed on it. Firstly, since no labor contract was signed, double the annual salary needed to be compensated.
Secondly, illegal termination of the labor contract, double compensation, 2N.
Finally, uncompensated annual leave, triple salary compensation.
Currently, labor dispatch in this area is becoming more and more formalized; at the very least, five insurances will be paid, so there are only three aspects.
When Zhou Yun takes action, it will definitely be a grand slam; anything that can be written will be written.
Liu Fusheng had been with the labor dispatch company for a little over four years. Calculating this, their company would have to pay the other party over 100,000!
"No, why? He's just a temporary worker. Why should we compensate him? He doesn't even work here!" Shi Yongqiang stood up directly and slammed the documents on the table.
The employee remained silent. He was a junior college graduate; asking him to explain why was expecting too much of him.
Although Shi Yongqiang worked in this field, his understanding of labor dispatch was still old-fashioned, seeing them as temporary workers who could be dismissed whenever desired.
When did dismissing a temporary worker require paying so much? There was no such rule in Fengxian County!
His understanding was not wrong. If the employee didn't pursue it, it wouldn't matter, but if they encountered someone who did, then what needed to be done still had to be done.
It's just that this process would be very troublesome, with many obstacles.
"Call Xiao Liu for me!" Shi Yongqiang spoke again.
Xiao Liu was the person in the company specifically handling contracts. He knew a bit of law but was an amateur.
Soon, Xiao Liu was called over, and he was also a bit confused looking at the documents in front of him.
"General Manager Shi, I specifically signed labor service contracts before, not that no contract was signed, nor was it a labor contract. There is no labor relationship between us and this Liu Fusheng."
"So he has no reason to sue us!" Xiao Liu said with certainty.
Hearing this, Shi Yongqiang nodded: "Alright then. They said the hearing is tomorrow. You come with me. I want to see what the hell the other side is trying to do!"
"This is bullying me!"
