And the fifth is a catch-all clause: other circumstances that lead to the breakdown of the marital relationship.

So you see, infidelity is not explicitly listed. As for cohabitation, according to the Supreme Peoples Court’s judicial interpretation of the Marriage and Family Code, cohabitation refers to: a spouse living continuously and stably with an opposite-sex person outside of marriage, not in the name of husband and wife.

So, how can a marital relationship be considered broken down? That is for the judge to determine.
