The legal basis is the “Rules for Educational Discipline in Primary and Secondary Schools (Trial)” promulgated in December 2020 and implemented on March 1, 2021.
Articles 7, 8, 9, and 10 of these “Rules” stipulate, from minor to severe, the disciplinary measures that schools and relevant departments can take.
Among them, Article 10 stipulates that for students whose violations are serious, or who do not correct themselves after multiple educational disciplines, the school may give disciplinary punishments such as warning, serious warning, demerit, or probation.
For students with serious misconduct, the school may, in accordance with legal procedures, cooperate with parents and relevant departments to transfer them to a special school for educational correction.
Many people may not be familiar with special schools. This used to be called work-study schools, which certainly makes it clear, but it was later renamed educational correction special schools.
That means, if they really can’t be managed, they are directly transferred to such special schools for education. To put it bluntly, it means not to keep them in normal schools to interfere with other students.
The “cooperate with parents” here is actually a polite way of speaking, because parents are guardians, and transferring schools certainly requires parental cooperation, but it should also be known that this is a “disciplinary measure,” which means punishment.
Parents must cooperate no matter what they think.
However, although the regulations have been out for several years, many people probably haven't seen this type of discipline. Why? Because it's very troublesome to implement.
How to do it? Article 43 of the “Law on the Prevention of Juvenile Delinquency” stipulates:
For minors with serious misconduct, if the parents or other guardians of the minor, or the school they attend, are unable to manage or manage ineffectively, they may apply to the education administrative department. After evaluation and approval by the special education guidance committee, the education administrative department shall decide to send them to a special school to receive special education.
As for what constitutes serious misconduct, Article 38 of the law lists eight situations and a catch-all provision.
In short, what schools need to do is to discover problems in a timely manner and manage and educate them promptly.
But in reality, whether it’s the school or the Education Department, they all want to do things in the easiest way possible. Primary schools are generally better, and junior high school is only three years, so they just muddle through and send the students away.
One can only say that the idea is good, but some students really cannot be muddled through. For example, Lü Xinhao, was he so bold from the beginning?
Did he dare to rob for money from the beginning? Did he dare to directly call people to gang rape?
That’s definitely impossible. At first, he would also have a fear of the school and the teachers.
But gradually he found that, hey, no matter how much trouble I cause, no one can control me, so I don’t need to be afraid at all. I can do whatever I want. There must have been a gradual transition period for this.
We actually have a complete set of regulations in this regard, not just the “Law on the Protection of Minors,” but due to various reasons, now… there’s nothing that can be done.
As for the responsibility of school leaders, Article 66 of the “Law on the Prevention of Juvenile Delinquency” stipulates that if state organs and their staff abuse their power, neglect their duties, or engage in favoritism and malpractice in the prevention of juvenile delinquency, the directly responsible supervisors and other directly responsible personnel shall be given sanctions in accordance with the law.
Article 67: Those who violate the provisions of this Law and constitute a crime shall be investigated for criminal responsibility in accordance with the law.
